Niagara Peninsula Standard Contract Document

A standardized contract document for road and municipal services construction across Niagara, developed to ensure consistency, fairness and competitive pricing for all parties involved in Regional construction projects.

About this document

The Niagara Peninsula Standard Contract Document establishes common terms, conditions and specifications for road and municipal services construction contracts across Niagara. Using a standard document means contractors can price tenders with greater confidence, owners receive more competitive bids, and less time is spent preparing and reviewing contract documents for each project.

The document was developed collaboratively by four key stakeholder groups and is intended for use:

  • Heavy Construction Association of Regional Niagara
  • Niagara area municipalities
  • Consulting Engineers of Ontario - Niagara Chapter
  • Niagara Region

How to use this document

The Niagara Peninsula Standard Contract Document is made up of standard sections that apply to all contracts, and project-specific sections that the owner or owner's agent completes for each tender call. Select a section for guidance on how it should be used.

This section is project specific and must be completed by the owner or owner's agent for each tender call. Key items to specify include:

# Item Notes
1 Named parties —
2 Tender procedure Specify the tender deposit amount and acceptable form (e.g. certified cheque, bid bond)
3 Estimated tender value —
4 Tender award Complete if approvals from review agencies are still outstanding (e.g. MTO, NPCA)
5 Maintenance holdback If required, specify here and under Special Provisions G19. If not required, enter "None"
6 Liquidated damages —
7 Additional insured Parties listed here are included as additional insured under Special Provision G1

This is a standard section. Any changes or additional instructions must be included in the Special Instructions to Bidders — do not alter this section directly.

This section is project-specific. The owner or owner's agent completes the schedule of quantities and issues it with the tender package.

Each item in the schedule of quantities must reference either an Ontario Provincial Standard specification number, an Niagara Peninsula Standard Contract Document special provision number, or a supplementary special provision. Only items referenced in the schedule of quantities will be in effect. Take care to ensure the correct specifications are cited.

The Form of Agreement included is a sample only. Each owner may use their own standard form of agreement, prepared and signed at the time of contract award.

This section is project-specific. The owner or owner's agent lists all applicable contract drawings, Ontario Provincial Standard Drawings and Municipal Standard Drawings for the project.

These provisions apply to the contract as a whole. They are a standard section — any changes must be made through supplementary special provisions, not by altering this section directly. All costs are distributed across applicable tender items.

These provisions relate to specific tender items and apply when referenced in the schedule of quantities. This is a standard section — changes must be made through supplementary special provisions.

Used when a project requires provisions not covered by the standard document. A supplementary special provision may modify an existing provision or introduce an entirely new one.

At the end of each construction season, the Specification Task Force reviews supplementary provisions used that year to determine if any should be incorporated into the standard document going forward.

This is a standard section. Any amendments to the General Conditions or Supplementary General Conditions required for a specific project must be included in the Supplementary Special Provisions.

If a geotechnical report has been prepared for the project, the entire report must be provided to the contractor as part of the tender package. Do not include only portions of the report.
