How to file a development charges complaint

If you think your Regional development charge was wrong, you can submit a formal complaint under the Development Charges Act, 1997.

You can complain if:

  • The amount of the charge incorrect
  • A credit you're owed wasn't applied or was incorrectly applied
  • There was an error in the application of the Development Charges By-law

How to submit a complaint

Write to Council and include your name, address and the reasons for your complaint. You must submit your complaint within 90 days of the date the development charge (or any part of it) was due.

What happens next

Council will hold a hearing and give you a chance to speak. After reviewing the evidence, Council will either dismiss your complaint or correct the error.

Within 20 days of the decision, the Regional Clerk will mail you a notice that includes the decision and the deadline to appeal. You have 40 days from the decision date to appeal.

How to appeal

If you disagree with Council's decision, you can appeal to the Ontario Land Tribunal. File a written notice of appeal with the Regional Clerk before the deadline, and include your reasons for appealing.

Refunds or additional charges

If Council or the Tribunal changes the development charge, the municipality will either refund the difference or collect any additional amount owing.
