Model Site Alteration Bylaw

Planning staff have prepared a model Site Alteration By-law to assist in the protection of sensitive lands and agricultural areas. Under the Municipal Act, the By-law can be adopted and administered by the local municipalities. Alternatively the local municipalities could work out agreements to delegate responsibility to the Regional level.

This model By-law attempts to deal with the following issues:

  • top soil preservation *
  • altering the grade of the land
  • filling in of valleylands and woodlots, and
  • the filling or draining of wetlands.

* Topsoil preservation is constrained by both the Topsoil Preservation Act and the Municipal Act, 2001 which provide exemptions for sod-farming, nursery operations, and the stripping of topsoil by greenhouse operations.
