Appealing a Decision

Gavel You have the right to appeal:

  • if you are found ineligible for financial help from the Ontario Works program
  • you disagree with the amount of financial help you are receiving

How to Appeal: Request an Internal Review

  • request an Internal Review within 30 days from the day you received a letter about a decision
  • the request for a review must be in writing, either by filling out a Request for Internal Review form or by writing a letter
  • your letter must say you are requesting a review and include your name, your member ID number (found on your benefit statement or the letter you received from Ontario Works), and your date of birth.
  • someone other than the casemanager who made the decision will review the facts of your case and will either confirm or change the decision
  • this review can be completed in person or by telephone
  • you should provide any additional information you have that could help in the review of the decision
  • you will be informed in writing of the internal review decision
  • you may withdraw your request for an internal review; however, if you do, you lose your right to appeal the decision to the Social Benefits Tribunal
  • send your Internal Review request to your local Social Assistance and Employment Opportunities office
  • if you are not successful with your appeal, you can appeal to the Social Benefits Tribunal

How to Appeal: Through the Social Benefits Tribunal

You may appeal to the Social Benefits Tribunal if:

  • you are not satisfied with the result of the Internal Review
  • your request for an Internal Review was not completed within 10 days

You must:

  • file your appeal within 30 days of the completed Internal Review. The Social Benefits Tribunal only hears appeals on certain cases
  • complete an Appeal Form which you can get from your local Ontario Works office or the Social Benefits Tribunal
  • send the completed Appeal Form to the Social Benefits Tribunal by mail, fax, or hand delivery to:
